Finals, yo. I'll speak in depth on it tomorrow. In short, NH was entitled to a JML. They threw out the test. Nobody got promoted. No discrimination occurred. But of course Scalia and Thomas will probably ignore all substantial legal analysis, and start beating the reverse discrimination/AA horse.

I'll give a real analysis tomorrow.

I agree.  But If the questioning at oral argument is any indication, it's going to go the wrong way, though.  It's a damn shame.  Meade did a good job, though.

D'oh!  I think there's a good chance that Kennedy might do the right thing here though.  How can they be successfully sued under Title VII for NOT taking action? (nobody was promoted)

So I'm in D.C. on some random business- decided to go last minute.  And they tell the group I'm with- "hey Arlen Specter (& his counsel)may be here tomorrow if we could push some of our other meetings out of the way." Then one of them turns to me and says "cui, I know you have to leave tomorrow but would you like to stay for that?" Shiiiiiit. Did you even have to ask?!?! hell yeah, I got some burning questions!

I don't think it's open to the public. It is a meeting with a bunch of minority bar associations- just talking about some joint initiatives. And they just got a meeting with Attorney General Holder. Grr, my flight tomorrow is before the meeting. Kill self? Or hop on a later flight back home?
