Another federal judge in CA has done the exact opposite.  See here:  http://www.eff.org/legal/cases/att/308_order_on_mtns_to_dismiss.pdf

As if it were not already certain that this one will be going to the Supremes...

Yeah, this was last week or so.  It was referenced in the article.  I don't think it'll go to the SCOTUS because it'll end up in the FISA Court.  If it does make it, the SCOTUS will rule on a technicality and defer to the FISA Court.  But who knows.
