ABA Loosens Attorney-Client Secrecy rules

SAN FRANCISCO (Reuters) - The American Bar Association on Monday narrowly passed a controversial proposal that will allow lawyers to pierce sacred attorney-client secrecy rules to help stop financial crimes.

 


In a 218 to 201 vote, the ABA's policy-making body amended its ethics code to allow, but not require, lawyers to breach attorney-client privilege if they believe doing so would stop a client from committing a financial crime or fraud.

But the question that remains is do you support this ruling or are against it?

It's a little vague.  Do you break confidentiality that prevents a client from commiting a crime if it would reasonably lead to their arrest? 

For that matter, what could you tell to whom that would prevent a crime but not lead to criminal charges?

If I tell the police that my client plans to murder someone, so as to prevent that crime, then my client is charged with attempted murder.

Well, I think the question is whether or not you can be convicted of attemped cheating. Or attempt to steal.

leave it to lawyers to have the rule of law replaced with the rule of whimsy.
