Author Topic: What is the Supreme Court's authority for remanding cases to the district court?  (Read 727 times)

Sometimes the SC will remand cases to the district court for further factfinding. I would like to know what is it's authority for doing this. In other words, is there a case in which the court holds that this is proper practice. Thanks.

There is a difference between common law(case law) and statutory law(written statues) their authority comes from the laws such as those in the state constitution. If your looking for a "precident" that allows them to do so, then the anwer is every since time they've done it since the 18th century.
