See Lucas v. Hamm (1961), a California case where the lawyer was cleared in a malpractice case for drafting an invalid will because he did not understand the rule.  The court said its too complicated for even a lawyer to understand and he couldn't have been expected to apply it properly; thus, no malpractice.
