For super bonus points on your essays, be sure to contrast the Cardozo v. Andrews view from Palsgraf (even if you sight no other case the entire exam, which you probably won't).  Torts professors eat that up (as do bar examiners).

Is this on target??

Cardozo doesn't trust juries on proximate cause --- even though they typically make the calll b/c prox. cause is a factual issue. So he came up w/ the "duty-based approach" - treats it more like the "duty element...", decides as a matter of law

Andrews = "the norm" - right?

Sue everyone.  Don't forget the intentional torts, eg intentional infliction of emotional distress.  Throw in the Hand formula and Palsgraf.  We were only allowed to use two pages, front and back, for notes so don't worry if your outline is short.
