Got Mnemonics?
« on: December 05, 2004, 08:00:25 PM »
I'm wondering if anyone out there uses mnemonics. I really like them, they are very helpful for memorization.
Wondering if anyone has any for Torts or Ks?
I have a few I will email (or post) if anyone wants them.

How about

FITTED CAB = 7 intentional torts

False Imprisonment
Tresspass to land
Tresspass to chattel

That "FITTED CAB"-thing is great, thanks..

I love these things, because they WORK.  I would appreciate any mnemonics you have, at bchase@mafs.tv.

I wish there was one for DEFENSES against intentional torts--that is the hard one for me.

They are, Consent, Self-Defense, Defense of others, Defense of property, Prevention of crime, Recovery of property, Legal Authority, and Necessity.

**ADDENDUM: Somebody reminded me I should have added "Statute of Limitations" to supra.  Duh!  I TOLD you I had a hard time remembering them!**

(That would almost have to be a SENTENCE...)

I assume everyone knows the acronym, M.Y. L.E.G.S., is "What type of K's have to be in writing per Statute of Frauds--contemplation of (m)arriage, requires over a (y)ear, interest in (L)and, executor of (e)state, (g)oods over $500, and (s)urety (promising to cover for the debt of another).

Here's a good one on Defenses Against Intentional Torts.  Another student at NWCU thought of it.  I wish I could think of these:

"NAPS in the CONDO PREVENT CRIME."--

(N)ecessity,
(A)uthority (Legal),
(P)roperty (Defense of/Recovery of),
(S)elf, Defense of,
(CON)sent,
(D)efense of
(O)thers,
PREVENT-ion of CRIME.

(Just remember Statute of Limitations.  Or, keep your malpractice insurance paid up; one or the other.)

Defenses against the formation or enforcement of a K:

S.U.M. F.I.G.--

(S)= Statute of Frauds.
(U)= Unconsionability (K of Adhesion, etc.)
(M)= Mutual Mistake (Raffles v. Wichelhaus.)

(F)= Formation (offer, acceptance, consideration.)
(I)= Incapacity (minor, drunk, insane, etc.)
(G)= "Garbage" or "Gangster."  I like "Gangster"--if you made a K with Tony Soprano, it would have ILLEGALITY, FRAUD, OR DURESS.

Thanks,
c
