When can the court consider illegality as an issue in a contract case?

Whenever they want.  They do not have to wait for it to be raised as an issue by one of the parties.

I created my contracts outline based on the table of contents of the casebook as suggested in a number of places.  I don't like that.  It seems disorganized.

When trying to satisfy the statute of frauds for an oral agreement followed by a writing, what must the writing contain?

if it is not glaringly obvious, I am not going to be prepared for this exam. Guess I should have spent less time posting on the board......
Seriously though, this stuff is hard for me to digest.....

The supporting writing only needs to refer to the agreement; it does not have to define the agreement.

Thanks. Perhaps instead of quizzing me you could just impart any wisdom you think I should know?

No, that won't work, because I'd have to organize my thoughts.
