A duty is owed to a person that a reasonable person would foresee unreasonable harm.

Trick question:
Under the rule of sevens, does a 20 year old have the capacity to consent?

Rule of 7s doesn't apply to adults, only to minors....seeks to determine maturity.
Consent is a defense, but it can be destroyed through scope, capacity etc.
Sales route cannot be converted. Dubya is a lost cause.
A duty is owed to a person that a reasonable person would foresee unreasonable harm.

I told you it was a trick question.  Rule of sevens goes to 21, but age of majority is 18

so strictly speaking....

OK.  I listened to the lecture while driving and I have a better answer.

When you violate a statute
and the act is the cause of the harm
and the harm is the type of harm the statute is intended to prevent
and P is in the class of people intended to protect

When is someone "negligent per se"?

I'm not 100% sure, but I believe it is when you break a law in the performance of a tort.
