In a trespass to land case in TN must there be damage?

Yes.  Otherwise why would you ask that question?

In Tennessee, are you ever excused from helping a person in distress?

No, otherwise why would you ask that question? There is no duty to aid in TN unless there is a special relationship, you have begun giving aid or ?????????

"Mistake is a defense only when it is made in connection with some other affirmative defense, but only if it is REASONABLE"
What are the other defenses to intentional torts?
