I have a question regarding AA and the question is this:

Private schools can do any sort of AA program they want, correct? It's only state schools that must comply with those initiatives or laws that get passed, right?

Sort of. They are still bound by non-discrimination laws if they accept public funds. Only a few most notably Bob Jones, refuse these funds. This means that can't openly discriminate. But they can do any sort of AA they want, since according preference to remedy injustice is not discrimination.
