I have a contract with you that says you will bake me chocolate cookies.

"A clause stipulates that if you are late in baking chocolate cookies, you owe me $1/day."

Is this a stipulated damages clause that precludes coming after you for other sorts of damages?  Or does it only say that you will owe me $1/day for lateness, leaving other questions of damages open?

The only stipulation provided by the clause is that I will owe you $1 if the cookies are late.  What if the cookies are not up to the quality specified in the contract?  Or what if you don't bake the correct quantity?  I think a true stipulated damages clause would cover all potential breaches.  Thsi only covers one scenario under which the contract could be breached.

Sorry, that was in bad taste.  I'm sure that you can miss an issue and still do very well because like others have said, almost no one spots every issue.  I'm a 3L and I walk out of every exam feeling like I missed some issues and I usually end up fine.

It's been awhile since I took torts but I am going to say that it would be a defense.  With strict liability you just have to prove the existence of an abnormally dangerous activity and causation.  Since the third party intervening conduct goes to whether proximate causation can be proven in the strict liability case, I think it would be a relevant defense.

I was mainly responding to OP's hatred of the other students.  I get your point, but I'd sure rather someone teach me the philosophy behind the law than just quiz me on having read it...

Students who aren't inept can generally read cases, statutes, and rules and figure them out on their own.

You should wait until you get some grades before calling anyone inept.
