I think you could likely make out a good case to fire him.
One can argue that his characterization of victims of September 11th as "little Eichmanns" as a type of hate speech which justifies his removal from teaching at a public institution. Other public employees have been removed from duty because of hate speech. Why should this case be any different? Let us say that his comments did not refer to the victims of the September 11th attacks as "little Eichmanns." Let us say that in his writings he referred to Matthew Shepard as a sinner who deserve to die or to the lynching of blacks as justified during the civil rights era as justified. I have no doubt that he would be fired from his public institution in a New York minute.
By the way, Churchill’s tenure has been removed.
For the person who brought up the ACLU’s possible defense of Churchill- good. The ACLU continues to destroy their public creditability by defending such people as Churchill.
