General Board / What I learned from my first semester of law school...

Thought this would be beneficial for us 1.5L's and anyone else who is about to start law school...

1. Do not put off outlining until November, keep up with your outlining every week.

2. Legal Research and Writing assignement will be a monkey wrench in your routine.  Plan accordingly, do not put off LRW for the weekends otherwise youll be in a race to finish them and thats not the best position to be in.

3. Flash Cards work wonders for memorizing Element and Factor based rules, but they dont supplement for actually studying the material.

4. Study, dont just read.  Ask questions while you browse through materials, find out whether the rule is a minority or majority rule.

5. Try to get your practice tests in 2 weeks before finals, messing up a previous test 3 days before a final can be a serious destriment to your self-confidence (even if it borders on hubris, its better to feel over confident than scared shitless)

General Board / Save money on canned briefs, go on Lexis!!!

Lexis offers brief synopsis of the case with all relevant information, why spend money on briefs... this semester im gonna save the 25$ each supplement costs and just use lexis exclusively.  You guys might want to give it a shot, it saved my ass last semester.

Product Liability actions arent always strict liability... in what instances can a product liability action be one in negligence rather than strict liability?

When I just started looking into law school everyone and their mother told me this was not possible.  I dont think thats true, anyone else find this to be the case?

Quick question, think i already know the answer just want to make sure... After i use my long cite for a case in a memo...
ex: Heiman v. Parrish, 942 P.2d 631 (Kan. 1997)
which short cite do i use... See id. at 633 or Id. at 633 ??

General Board / Black Letter Law...

Im curious about something, have any 1L's started divining the black letter law from the cases they have been reading?? basically when i read a new case and book brief it with a little extra time i could probably pull the BLL out of it but is that what you are supposed to do or is it more of linking a group of cases together and seeing how each of them relate (or dont relate) to each other and then derive the BLL... any ideas??

General Board / The study habits of others...

I heard a million and one times never look at the study habits of your colleagues but sometimes i feel like such a slacker when i look at the effort some of my classmates apply to class... personally, im an attentive listener in class but i rarely take notes.  I highlight my cases right in the book (book brief) then writing a sentence or two in the margins to give myself an idea of wtf the case is about.  I noticed, however, that some people go all out with long sets of typed notes and they type up all their briefs... does anyone feel that this works better for them??

General Board / Observations about Civ Pro...

Is it just me or does this class, contrary to what people say, require you to memorize and regurgitate a whole bunch of rules.  I have a photographic memory so this wouldnt be a huge problem, i just want to know if anyone else feels that way.  We spend more time getting quizzed in which Joinder rule applies to the situation, i feel as though the class is conditioning us to be mindless machines.  Just my two cents.  Personally, my favorite class is torts.  The casebook reads like a novel or at least a script for realTV.  I find myself saying, "whoa, 4 fingers amputated. Well done!"

Im gonna be going to Seton Hall Law in Newark.  Just wondering if any of you guys (and girls) are gonna be joining the ranks of Newark's elite.
