he can ask about specific instances on bad acts in cross examination but not through his own witnesses on direct (see FRE 405)

Yes, but the specific instances that can be inquired into on cross are limited by 404's prohibition of "propensity" evidence (action in conformity therewith). The relevant part of 405(a) is : "On cross-examination, inquiry is allowable into relevant specific instances of conduct." This rule does not negate the rule against pure propensity evidence.

the propensity of 404 does not apply b/c its a specific exception to 404, (404(a)exception)
however, its still subject to a 403 balancing test, so if its found too prejudicial it might be kept out- or subject to a limiting instruction

Current Law Students / Re: Length of your outlines
« on: November 20, 2007, 09:05:53 AM »
my "outlines" are incredibly long and thats why i put that in parantheses.  they are usually around 80 pages long.  however, they are not practical for the test.  they are me putitng my thoughts down/organizing and LEARNING the material. after i finish the 80 pages i then make an outline of my outline and bring both into the final.  it worked well for me and i ended up with great results from it.

while you may think "wtf 80 pages?" thats whats works for ME. i make sure i have everything, every point of every case and everything we did in class with details.  HOWEVER, i organize it according to big, major points of BLL and then break off into detail.
