LSAT scores indicate how well you take the LSAT.

Law school exams measure how well you do on law school exams.

They indicate nothing beyond that.

An important question is what kind of employment. 

If it is employment at will, they can ask you to do things to continue employment.  As SLF said, the consideration would be continued employment.

If you have an employment contract for a specific term, anything they ask you to do is a modification of the contract and requires additional consideration.

Going on with employment at will and arbitration...  you could argue unconscionability.  Depending on the terms of the arbitration agreement, it might be unconscionable as many are.  One procedural ground for unconscionability is the superior bargaining position of the employer.  If it is strong enough you can argue that they overbore the will of the employee.  Then you just need to find some term in the arbitration agreement that is grossly unfair and so on.

Yup.

And correct me if I'm wrong, but the UCC is law in all 50 states.

I would argue either conflicting terms are knocked out, thus leaving parties to gap filling provisions under article 2, OR
the additional terms (warranty stuff by both parties) materially alter the K so are not included, and NO gap filling provisions used.

Last night in contracts, two people who had briefed before were called on.

I have yet to be called on in any class.

I agree. I liked the prep information and other tips in the book. I didn't totally buy into the attitude.

It was especially inappropriate for my school.

I dislike this class, too.  I want to be somewhere else when it's time for this class.  Unlike all my other LS classes.

i hate this class with a f**cking passion.  closed memo and open memo for us.  GRADED, not P/F (love the fact that our school is trying to use that a selling point)
