General Board / Intrastate laws
« on: July 18, 2007, 11:52:05 AM »
A company in NY rented A/Cs from vendor (in NY) and used a shipping/messenger service (in NY) to deliver the goods with trucks from vendor to the company. When the A/Cs arrived, they were damaged en route which costs $1500. This money needs to be paid to the vendor. What liability does shipping company have? Where can I research for New York laws that govern? I have searched everywhere. WHere can I find State laws or cases or regulation that talks about limitation of liability in NY?

Hi, I am trying to find Boston anti-graffiti laws and vandalism, anti-graffiti code of ordinances, or municipal codes, or penal codes and I can't find any. I have tried Lexis and Westlaw but no luck. Any suggestions? Thanks.

General Board / Memo

A company is planning to do a marketing campaign and using powerwash graffiti in 5 major cities regardless of the legal consequences. I've been given an assignment to research what the graffiti laws in each of the cities are, specifically on vandalism and other laws construed, and what the consequences are. The company wants to know what the "pissed off" laws are. How should I structure my memorandum? Should I give each city a paragraph or 2 on the city's graffiti laws? Each state also has their own definition of what is considered graffiti and vandalism, how can I organize that?

General Board / Suggestions please

Hi, I originally applied for a legal internship working under in house counsel. I'm currently interning for a large entertainment company but the Human Resources are very misleading b/c they said they will put me in legal department but they placed me in Photo Licensing department (the only thing legal about this is filling out license agreements which are templates- no lawyers and full of college interns). Now, the actual legal department has no more summer openings. There is an opening for the Fall for the legal department but I haven't gotten any response yet. I don't know if I should stick through this doing bozo work (clerical work) in hopes that I will get to work at the legal department in the fall or seek another internship at a smaller company working under an in house counsel. I know if I pull out now, I might burn a bridge and I will probably not be able to apply here again. Any suggestions?

Hello everyone, I can't seem to figure out what the issues are other than breach of duty of loyalty from this business assoc/corporations hypo. What do you guys think? Thanks

HYPO: G and H opened a restaurant. G is a great cook and has recipes passed down from his grandmother. He is
responsible for creating menus and meals. H is responsible for being host and arranging parties. G and H agreed to split revenues 65% for G and 35% for H, but each responsible for expenses associated with their specific endeavors. H would pay for waiters' salaries and G would pay for salaries of cooking staff & food ingredients. G would pay rent, utilities, insurance, and ads.

A yr later, G wanted to expand restaurant and G signed lease to open another one. H dissaproved and wants to
get out of it.

Also, G took his grandmother's recipes to a publisher and got a book contract. H found out about book
contrat and that all royalties will go to G. Business has now declined and both want to get out of the
situation. Both believe the other committed breaches of various duties. G comes to you for advice.

State of CA has enacted law banning sale or possession by individuals of monkeys and apes. Governor Greg, signing new law, announced, “Too many kids bitten by these wild animals in our state. They belong in the wild or zoo, not in homes.” A fed law authorizes Secretary of Interior to prohibit importation or sale of “dangerous animals,” and empowers her to adopt list of such animals. But official has declined to add monkeys to list. Your client, P, is arrested by State Police for harboring monkey in his home. This hypo about wild animals is confusing me. Does anyone know how I can challenge State law on constitutional grounds besides procedural due process?
